Scott Holbrook, Jr. is a partner
with Crawford & Bangs, LLP. and has been with the firm for more
than 25 years. Mr. Holbrook is Legal Counsel to the Los
Angeles/Orange County/Inland Empire Chapter and Legal Counsel to the
California Chapter of the American Subcontractors Association.
On a national level he serves on the Board of Directors for the
American Subcontractors Association and was Chairman of the American
Subcontractors Association Attorneys Council in 2007-2008 as well as
serving on the National Task Force for Model Subcontracts since 2000.
He is also a member of the Christian Legal Society and the Los Angeles
County Bar Association Construction sub-section.
In his work with the firm, he
represented one of the subcontractor claimants that abolished
“pay-if-paid” in California in William Clarke v. Safeco (the
only subcontractor that was awarded attorney fees as part of the
decision). Additionally, he has written numerous amicus briefs on
behalf of subcontractors including most recently in Hernandezcueva
v. American Standard (whether subcontractors can be strictly
liable for inherently dangerous materials installed); Eggers
Industries v. Flintco, Inc. (2nd tier supplier is
“subcontractor” when providing manufactured items pursuant to
specifications); Crawford v. Weathershield (duty to defend
without negligence showing); and Great American v. LAUSD
(owners implied warranty of plans) in cases before the California
Supreme Court as well as in Vandenberg v. Superior Court to
expand insurance obligations of defense and indemnity to
subcontractors in California. In addition to representing clients in
Federal and State Courts at the trial and appellate level, Mr.
Holbrook represents clients before the General Service
Administration’s Board of Contract Appeals, the Contractors' License
Board, and the American Arbitration Association.
Mr. Holbrook has spoken before
numerous construction trade groups and conferences including the
American Subcontractors Association, Insulation Contractors Association
of America, Painting and Decorating Contractors Association, American
Society of Concrete Contractors,
National Association of Women in Construction, Western States Surety
Conference, Los Angeles County Bar Association Construction sub-section
and others. Additionally he has had published in ASA’s Contractor’s
Compass, “How to Incorporate a Subcontract Addendum in Your Bid” and a
viewpoint argument regarding California’s “pay-if-paid” decision in
Engineering News Record as well as other construction law related
articles in other construction trade publications.
Mr. Holbrook has
been married over 25 years to his wife Marla and they reside in West
Covina, California with their three children.
